This page is used to inform website visitors regarding our Terms & Conditions regarding the use of TypewriterPoetry.com (which includes, but is not limited to, the blog, the shop, the poems, & the informational pages herein.)
If you do not agree with any of these Terms & Conditions, you may not use nor access TypewriterPoetry.com. These Terms & Conditions apply to all visitors, customers, users, & others who access TypewriterPoetry.com.
By using TypewriterPoetry.com, you agree to be bound by the current version of these Terms & Conditions (which also incorporates our Privacy and Cookie Policies), and also agree that you are responsible for compliance with any national or local laws relevant to its use, whether or not you are a registered user of our Services.
Intellectual property is protected by law. Typewriter Poetry is a project of The Infinity Lab, which operates TypewriterPoetry.com and provides the Typewriter Poetry blog, shop, and poems. TypewriterPoetry.com and the writers, photographers, or designers reserve all copyright and other intellectual property rights associated with the images, content, and website material unless explicitly stated. TypewriterPoetry.com will not tolorate any infringement of their rights or any loss of or damage to their goodwill caused by such infringement. Legal proceedings will be commenced without further notice in the event of any infringement of intellectual property rights vested in TypewriterPoetry.com. The same shall apply to breaches of the Terms & Conditions of use.

We do our best to ensure that the information on TypewriterPoetry.com is complete, accurate, and current. Despite our best efforts, the information on TypewriterPoetry.com may be occasionally inaccurate, incomplete, or out of date. All specifications, products, descriptions and prices of products on TypewriterPoetry.com are subject to change without notice at any time. We make all reasonable efforts to accurately display the attributes of our products, including the applicable poems.
We do not warrant the accuracy or completeness of the information, content, or materials provided through TypewriterPoetry.com. The inclusion of any products or services on TypewriterPoetry.com at a particular time does not imply or warrant that these Products or Services will be available at any time. We reserve the right to discontinue any product at any time.
These Terms & Conditions shall be governed by and construed in accordance with California law. Any disputes arising in connection with this Terms & Conditions are subject to the exclusive jurisdiction of California and the United States of America.
Information Collection and Use
For a better experience while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to your name, phone number, and postal address. The information that we collect will be used to contact or identify you.
We want to inform you that whenever you visit our Service, we collect information that your browser sends to us that is called Log Data. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.

Our Services do not address anyone under the age of 13. We do not knowingly collect personal identifiable information from children under 13. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do necessary actions.
Terms of Sale
By placing an order with us, you are: i.) offering to purchase a product, ii.) representing that you are of legal age to form a binding contract, and iii.) representing that all information you provide to us in connection with such order is true and accurate and you are an authorized user of the payment method provided. The receipt by you of an order confirmation does not constitute our acceptance of an order. We retain the right to refuse any order request made by you.
Prior to our acceptance of an order, verification of information may be required. We reserve the right at any time after receipt of your order to accept, modify, or decline your order or any portions thereof, even after your receipt of an order confirmation from us, for any reason whatsoever. We reserve the right to limit the number of items ordered and to refuse service to you without prior notification. In the event that an item lists an incorrect price, either due to typographical or other error, we shall have the right to refuse or cancel any such order placed for the incorrect price, regardless of whether the order is being or has been processed. If payment has already been made or if your account has already been charged for the purchase and the order is cancelled, we will credit your account in the amount of the incorrect price.
Our Products are offered subject to availability. If for any reason we cannot supply you with any part of your order, we will contact you via email or phone to advise you. We may need to cancel or refund the item from your order, in which case the funds will be paid directly back to your account. Payments will be refunded to the card or bank used to purchase the goods. Prices are subject to change without notice. TypewriterPoetry.com reserves the right to refuse any order, at our sole discretion. However, if we do refuse your order, we may tell you our reasons.
When purchasing a handmade, typewritten poem, please note that the actual Product you receive will depend on the output of typing it by hand, and since all poems are handmade upon order, we cannot guarantee that the poem you see on your device’s screen will be the exact replica of what you receive in your order. In fact, part of the charm of our Products comes from the handmade, typewritten process–which is bound to include errors such as typos and layout. As such, no refunds will be guaranteed if you find yourself in possession of a poem with such quirks. With that being said, we do our best to make sure each Product looks & functions exactly the same as the others, going as so far to take measurements regarding placement and typography. If in the event a drastic typewritten mistake occurs, we will not sell it to any customer for full price, but at a discounted sale.
TypewriterPoetry.com allows customers to use various forms of payments during Checkout. TypewriterPoetry.com customers can pay with PayPal (which accepts credit cards and debit cards) or BACS. This policy explains all of the customer’s rights and obligations when making a payment on TypewriterPoetry.com.
Payment Methods, Invoices, Billing, & Credit
Payment for goods is to be made via PayPal. Unfortunately, we cannot accept payment sent in the form of cash or checks and are not responsible for loss. Your credit or debit card will be charged immediately. In the case of possible returns, the amount paid will be partially refunded at 75% (with a 25% retained by TypewriterPoetry.com as we do not accept returns for custom, handmade Products). Should your account have insufficient funds, we reserve the right to invoice you for the costs incurred in making requests for payment.
Subscriptions & Recurring Payments
Some of the Products, such as the purchase of custom, handmade Products, may consist of an initial period, for which there is a one-time charge, followed by a recurring period of charges as previously agreed by you. By choosing a subscription payment, you acknowledge that such Services have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. All recurring payments are fully earned upon payment.
Currently, handmade Poetry Care Packages take 5 – 7 business days to make. They are immediately shipped upon approval of the customer the following business day.
Except as outlined below, TypewriterPoetry.com offers free shipping on both domestic & international orders. If in the future shipping becomes charged, all customers will be notified at the time of purchase during Checkout. Shipping charges will be based on weight and distance and vary slightly from our main location in the San Fernando Valley, Los Angeles (California, USA). By making a purchase, you agree that you accept the Shipping Policy which have been notified to you.
We do not track shippings. If you would like your shipment to be tracked, please contact us for details. Any shipping tracking requests will incur a tracking fee based upon our discretion.
If you wish to update or change your order, please contact us at [email protected] . We’ll do our best to make last-minute changes for you, but we can only guarantee changes (including the delivery address and in relation to custom poems) that are requested within 24 hours of the order being placed if delivery is not due the following day. At peak times, we begin processing orders earlier than usual to account for the large volume of deliveries. This means we may need 1-5 days notice for any changes to be made to your order.
We are not responsible for any delays outside of our control. If our supply of the Products or any related Services is delayed by an event outside our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this we will not be liable for delays caused by the event. You may contact us to receive a refund for any Products you have paid for but have not received.
Within 14 days of receiving your order, you must notify us of any items you would like to return. You have 14 days in which to return the items back to us. Please note you are responsible for the items until they reach our facilities. If you are returning a custom poem, poetry care package, or letter, we will only refund you 75% of your order to account for the destruction of the envelope due to mailing transit. If you return the Product in its original packaging (by not destroying the envelope), you will have returned the Product in re-salable condition and qualify for the full 100% refund.
Disclaimer: Warranties & Limitation of Liability
TypewriterPoetry.com, to the extent allowed by applicable law, expressly disclaims all implied and expressed warranties with regards to any information, materials, graphics on the website, and with regards to any Products or Services sold on or through the website. This disclaimer of all implied warranties includes, without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. All Products are sold “As Is,” and are subject only to the return policy set forth in these Terms & Conditions.
Under no circumstances shall any party, its subsidiaries and affiliates, their respective directors, officers, employees or agents, and other representatives, be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to lost profits and business interruption, whether in contract or in tort, including negligence, arising in any way from the use of the Website, Products, Services, and/or the Contents thereof, or of any hyperlinked website even if such party is expressly advised of the possibility of such damages. With the exception of damages related to legally proven or admitted intellectual property infringement caused by Products and/or Services as delivered by a party without any third-party content, in no event shall a party’s liability exceed the total sums received by TypewriterPoetry.com from you during the twelve month period immediately prior to the date the damages first occurred.
We may employ third-party companies and individuals due to the following reasons: i.) to facilitate our Service; ii.) to provide the Service on our behalf; iii.) to perform Service-related services; or to assist us in analyzing how our Service is used. We want to inform our Service users that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
